UM DESAFIO PARA UMA DEMOCRACIA INCLUSIVA: O RECONHECIMENTO DO DIREITO DE VOTO PARA REFUGIADOS

O presente trabalho propõe o estudo do reconhecimento do direito de voto para refugiados no Estado de acolhida. Inicialmente, o artigo aborda experiências já existentes de reconhecimento do direito fundamental de voto a estrangeiros, de modo a demonstrar que tal prática não constitui uma anomalia no sistema internacional. O trabalho prossegue detendo-se sobre a figura-limite do refugiado, o qual, pela sua simples existência, demonstra a fragilidade de um sistema de organização política e de reconhecimento de direitos fundamentais calcado em legados da modernidade, como Estado-nação e nacionalidade. O artigo põe em discussão argumentos favoráveis e contrários ao reconhecimento do direito de voto a refugiados, de modo a suscitar o debate. Em suma, o trabalho propõe repensar os fundamentos de organização política e a vinculação entre direitos e nacionalidade.
