Resumo

O artigo propõe a discussão a respeito de como o movimento dos transgêneros pode questionar a ideia de “humanidade” presente no conceito de direitos humanos, a partir do tratamento desumano conferido aos componentes do grupo social. Com base na zona de indistinção entre o humano e o inumano, o texto apresenta o problema da transfobia e como a violação das regras presente no contrato social de gênero pode ser considerada premissa para a negação da humanidade de tais indivíduos. Procura, assim, avançar as reflexões sobre a liberdade de concepções normativas de gênero e promover a democratização contínua das relações de gênero.

Kendall Thomas, Columbia University

Kendall Thomas is the Nash Professor of Law and co-founder and director of the Center for the Study of Law and Culture at Columbia Law School. His teaching and research interests include U.S. and comparative constitutional law, human rights, legal philosophy, feminist legal theory, critical race theory, and law and sexuality.
