NOVOS DESAFIOS AO DIREITO INTERNACIONAL HUMANITÁRIO: A PROTEÇÃO DOS BENS CULTURAIS EM CASO DE CONFLITO ARMADO

O presente trabalho propõe a estudar Direito Humanitário sob a perspectiva da proteção dos bens culturais, haja vista a inúmera quantidade de conflitos armados existentes, tanto no plano interno quanto no plano internacional dos Estados, os quais destroem parcial ou totalmente o patrimônio cultural de certas localidades. A essência deste artigo, portanto, resta na analise da existência de um novo desafio para o Direito Humanitário, tendo em vista que a tutela desses bens compõe o rol desse regramento e a mesma parece não ser observada. Logo, além de estabelecer a construção dos conflitos armados hodiernos, busca-se a análise de sua origem e evolução histórica, em especial na proteção dos bens culturais, a fim de estabelecer a justificativa para a sua existência. Ainda, o conteúdo do texto se inclina ao estudo da efetividade do Direito Humanitário sobre bens culturais, buscando em precedentes do Tribunal Penal Internacional para a Ex-Iugoslávia uma análise da sua aplicabilidade na modernidade.Downloads
