O NOVO FUNDEB E O DIREITO À EDUCAÇÃO: AVANÇOS NA POLÍTICA DE FINANCIAMENTO?

The scope of this paper is to analyze how the new FUNDEB has contributed to improving education financing in Brazil, with a view to ensuring quality education for all citizens. A literature review was the starting point for interpreting the factual object studied, and the deductive method was used to make this theoretical study concrete. It is worth noting that the intersection between the economic analysis of law and education financing can be understood through the use of economic principles in the analysis of the efficiency, equity, and effectiveness of public education policies in the country. To this end, a comparative analysis was carried out with previous forms of education financing in Brazil to assess their progress. Both mandatory and free education were addressed in the context of the Right to Education, as well as the allocation of resources and the financial commitment of the various levels of public administration to universalizing primary education and eradicating illiteracy. The economic analysis of law applied to education reinforces the importance of fair and efficient allocation, boosting social development. It is essential to seek to build healthy and fair societies, because without an efficient educational system, the progress of any country is seriously compromised.
