Abstract

Resumo: O presente artigo analisa a responsabilidade civil em matéria ambiental à luz dado acórdão do TJ/SC proferido pelo Dês. Luiz Roldão de Freitas Gomes. Após uma breve abordagem da evolução histórica da legislação ambiental, estabelece a relevância e as conseqüências da decisão para o Direito Ambiental brasileiro. Ao final, demonstra que a responsabilidade civil objetiva ambiental vem sendo aceita pelos tribunais brasileiros. Palavras-chave: responsabilidade civil-dano ambiental-poluidor This article aims at the analysis of the civil responsibility in environmental areas according to court decision of TJ/SC (Court of Justice from Santa Catarina) pronounced by the Supreme Court Judge Luiz Roldão de Freitas Gomes. After a brief approach of the historical revolution of environmental legislation establishes the relevancies and consequences of the decision to the Brazilian Environmental Law. In the end, it demonstrates that the civil responsibility is being accept by Brazilian courts. Keywords: civil responsibility, environmental damage, pollutant.
