AS TRÊS LEIS DA ROBÓTICA NA ERA DO BIG DATA

O trabalho examina os desafios das tecnologias emergentes, como robôs, inteligência artificial e algoritmos, na Sociedade Algorítmica. Contrasta-se o "Complexo de Frankenstein", que teme máquinas malévolas, com as Três Leis da Robótica de Isaac Asimov, ressaltando que, na prática, surgem questões legais e interpretativas que exigem regulamentações focadas nos seres humanos que desenvolvem e operam essas tecnologias. Argumenta-se que a governança deve priorizar a boa-fé, transparência e responsabilidade dos projetistas e operadores, em vez de se concentrar apenas nos dispositivos. A "falácia do homúnculo" é utilizada para criticar a falsa ideia de que existe uma entidade humana dentro dos programas de IA, destacando a necessidade de regular a programação e o uso dos dados. Além disso, discute-se o “efeito de substituição”, onde IA e robôs substituem humanos, impactando as dinâmicas sociais. Por fim, propõem-se três princípios jurídicos fundamentais para orientar as interações na Sociedade Algorítmica: deveres fiduciários, obrigações públicas e a prevenção da externalização de custos, aplicando esses princípios tanto a empresas digitais quanto a governos.
