THE FREEDOM OF CONVICTION AND BELIEF IN THE AMERICAN CONTINENT

The article aims to analyze situations in which there has been some degree of violation of fundamental rights related to freedom of conviction and belief in the American Continent. The theoretical-methodological substratum is that of the Sociology of Law and Religion, which is an interdisciplinary and innovative approach. The methodological procedures consist of the jurisprudential and socio-legal analysis of the cases submitted and analyzed or by the Inter-American Commission on Human Rights and the Inter-American Court of Human Rights. The results achieved refer to the plurality of cases submitted, the relevance to the thematic approach to religious freedom and the confluence of intervening sociological factors, which, together, elucidate the set of elements addressed. The conclusions show the peculiarities of the results obtained in view of the complexity of the relationship between law and religion in America.
