FEDERALISMO, FACÇÕES E FREIOS E CONTRAPESOS NA EMERGÊNCIA DO CONSTITUCIONALISMO NORTE-AMERICANO

O presente artigo tem como objetivo analisar a obra O Federalista de autoria de Alexander Hamilton, James Madison e John Jay em seus principais aspectos que serviram de base para o desenvolvimento do constitucionalismo norte-americano, em especial aos fundamentos do federalismo. Deste modo, mostra-se o Estado originado pela Constituição de 1787 uma forma de organização política inédita, superando o modelo das então antigas confederações. Da mesma forma, demonstra-se o equilíbrio buscado por Madison, evitando os extremos de tirania e anarquia, especialmente pelo fenômeno da formação das facções. Além disso, o sistema de freios e contrapesos se mostra como um aprimoramento da rígida doutrina da separação do poder, de modo a permitir um melhor encaixe na tensão entre interesses no exercício das funções soberanas do Estado.Descargas
