REFORMA DO JUDICIÁRIO E ESTADO DE DIREITO: ANÁLISE DAS MUDANÇAS INSTITUCIONAIS NA AMÉRICA LATINA NOS ANOS 90

Resumo

Embora exista um consenso sobre a centralidade do Estado de Direito tanto para o desenvolvimento econômico quanto para a consolidação democrática, a economia política da reforma do judiciário permanece amplamente subteorizada. O artigo de revisão destaca as tensões e compensações entre as diferentes estratégias e objetivos da reforma judicial na América Latina, com maior ênfase na análise do Brasil, destaca o delicado equilíbrio entre independência e responsabilidade. Também avalia o papel das instituições doadoras e, em particular, dos bancos multilaterais de desenvolvimento, na promoção da reforma judicial que facilite sua ideologia econômica, que defende uma abordagem mais realista da governança judicial, com foco em reformas viáveis

Graduação em Direito (PUC-Campinas), Especializações em Direito Constitucional e Direito Processual Civil (PUC-Campinas), em Didática e Prática Pedagógica no Ensino Superior (Centro Universitário Padre Anchieta), Mestre e Doutor em Direito Político e Econômico (Universidade Presbiteriana Mackenzie), Pós-Doutor em Direito (USP). Pós-Doutor em Economia (UNESP-Araraquara). Professor do Programa de Pós-Graduação em Direito Político e Econômico da Faculdade de Direito da Universidade Presbiteriana Mackenzie. Professor Colaborador da Maestría em Economía Social da Universidad Autónoma de Guerrero (Acapulco, México). Membro do CIRIEC-Brasil.
