THE LAW AMONG HUMANS OF ALL SKIN COLORS

In an increasingly plural society inhabited by humans of different skin colors, the control of social relations becomes a challenge for the Law. Practices of crimes of racist relevance are persistent and a real affront to fundamental rights. Although the State is conceived as a guarantor of fundamental rights, it is also true that in private relations citizens must observe such rights, under penalty of offense to the Constitution. This paper aims to reflect on the interconnection between fundamental rights and private rights, relative to facts concerning skin color. The effectiveness of fundamental rights obliges individuals to have not only a social and political duty, but also a legal duty to recognize differences and respect diversity in building a just society, more tolerant and more egalitarian in all skin colors.
