ETHICS REGULATION AND THE LEGAL FRAMEWORK FOR ARTIFICIAL INTELLIGENCE IN BRAZIL

This paper aims to address a pair of questions: (i) is ethics, on and by itself, sufficient to regulate artificial intelligence - AI or should it be addressed by a formal legal framework?; and (ii) what are the ideal features for this legal framework and how the legislative AI proposal, as approved in the Brazilian House of Representatives, reflect these features? Drawing from the so called Technical Constitution, the article examines the main traits of ethics in regulating AI, its merits and setbacks, verifying its shortcomings as a tool for AI systems development and applications. Furthermore, after identifying the essential regulatory elements for an effective AI governance, we concluded that the Brazilian Parliament proposal for AI enjoys a robust level of adequacy to these essential regulatory elements. For this goal, the methodology we used included bibliographic review and state of the art literature related to artificial intelligence and data protection.
