LIMITES DO PODER JUDICIÁRIO NA LUTA CONTRA A ESCRAVIDÃO CONTEMPORÂNEA NO BRASIL

Over more than two decades, Brazil has developed a set of regulations and public policies dedicated to eradicating contemporary slavery, which have helped rescue around 63,000 workers. However, in 2016 it was the first American state to be condemned by the Inter-American Court of Human Rights for failing to ensure compliance with the international agreement on the subject. There are contradictions in the application and interpretation of legislation that help perpetuate this crime in society. This article analyzes the main inconsistencies currently existing in the Judiciary and proposes reflections with the aim of improving the interpretative activity of judges and courts.
