LITIGATION AS CROSS-CUTTING GOVERNANCE IN PROMOTING DEMOCRACY, CLIMATE JUSTICE, MITIGATION AND REPAIR OF DAMAGES AND DISASTERS

This article examines how climate litigation can promote climate justice and democracy, and through these instruments mitigate and repair anthropogenic climate damage and disasters. Using the hypothetical-deductive methodology, the study asks the following question: can climate litigation actions serve as an instrument of effectiveness and promotion of climate justice and democracy for a new global governance of a transversal order? To prove the research problem, it analyzes data and specific cases to test these hypotheses. The results suggest that the proposed instruments of a transversal order guarantee a new climate governance and can be a powerful tool to hold governments and corporations accountable for damages, promoting a more just and effective environmental Governance
