HORIZONTAL OR THIRD-PARTY EFFECT OF HUMAN RIGHTS: INTERNATIONAL DECISIONS AND NATIONAL TENDENCIES IN RETROSPECTIVE
Resumo
This paper aims to describe the phenomenon of horizontal or third-party effect of human rights under international law, through its concept, application and enforcement. This phenomenon is ruled by the codes of conduct for multinational corporations issued by the Organisation for Economic Co-operation and Development and by numerous norms issued by the International Labour Organization. Some relevant international claims judged by the European Court of Human Rights and the Inter-American Court of Human Rights will also be addressed here. Last but not least, this paper will present some general tendencies of the debate on third-party effect of human rights in some countries, e.g. Germany, US, France, Spain, Portugal and Brazil.Downloads
