Abstract

This article analyzes the crime of contempt in the Inter-American System of Human Rights, addressing the regulation and interpretation of the exercise of freedom of expression and its limits at the international level, comparing them with the Brazilian position in relation to the application of laws that criminalize the contempt of civil or military public officials existing in the country, and analyzing the challenges to preserve the effectiveness of the exercise of freedom of expression in the light of the international commitments assumed by Brazil.

Daniela Bucci, Faculdade de Direito da Universidade de São Paulo (USP)

Doutora (2016) e Mestra (2012) em Direitos Humanos pela Faculdade de Direito da Universidade de São Paulo (USP). Atualmente é coordenadora do Observatório de violação de direitos humanos da região do Grande ABC (ODHUSCS) e Professora Pesquisadora (líder) do Grupo de Pesquisa (CNPQ) Direito e Novas Tecnologias da Universidade Municipal de São Caetano do Sul . É pesquisadora do Núcleo de Estudos de Tribunais Internacionais da Faculdade de Direito da Universidade de São Paulo (NETI-USP), coordenando atualmente o subgrupo Cortes de Direitos Humanos. Professora nos cursos de graduação e pós-graduação na área de Direitos Humanos e Direito Constitucional.

 

Andre de Carvalho Ramos, Faculdade de Direito da Universidade de São Paulo (USP)

Professor da Faculdade de Direito da Universidade de São Paulo (USP - Largo São Francisco). É Professor Titular e Coordenador do Programa de Pós-Graduação Stricto Sensu – Mestrado – da Unialfa. É Livre-Docente e Doutor em Direito Internacional pela Faculdade de Direito da Universidade de São Paulo (2000). Foi visiting fellow do Lauterpacht Centre for International Law (Cambridge). É Procurador Regional da República. É Coordenador Nacional do Grupo de Trabalho "Migração e Refúgio" da Procuradoria Federal dos Direitos do Cidadão (2020-até o presente). É o observador do Ministério Público Federal no Comitê Nacional para os Refugiados (2020-até o presente).
